Refund & Dispute Policy

This Refund & Dispute Policy (the “Policy”) governs the terms under which refunds may be requested and disputes may be resolved with respect to services purchased from Parthenope Adventures (“the Company,” “we,” “us,” or “our”). By booking and/or participating in any tour, event, or related service offered by the Company, you (“Customer,” “you,” or “your”) acknowledge and agree to be bound by the terms of this Policy.

1. Definitions

1.1 “Tour” refers to any guided excursion, activity, or experience provided by the Company.
1.2 “Booking” refers to the act of reserving a Tour and completing the associated payment process.
1.3 “No-Show” refers to a situation in which a Customer fails to attend a scheduled Tour at the agreed-upon location and start time without having canceled in advance.

2. Cancellations by Customers

2.1 Cancellation Window and Refund Eligibility

Full Refund: A written cancellation request received by the Company at least seven (7) days prior to the scheduled Tour date qualifies for a full refund of amounts paid.

Partial Refund: A written cancellation request received three (3) to six (6) days prior to the scheduled Tour date qualifies for a fifty percent (50%) refund of amounts paid.

No Refund: A written cancellation request received less than seventy-two (72) hours prior to the scheduled Tour date will not be eligible for any refund.

2.2 No-Show Policy
If you fail to appear at the designated meeting point on the date and time of the scheduled Tour without having provided prior notice to the Company, you will be considered a No-Show. No refunds or credits will be issued under such circumstances.

2.3 Method of Cancellation
Cancellations must be submitted in writing via email to info@parthenopeadventures.com, unless otherwise specified by the Company.

3. Cancellations or Modifications by the Company

3.1 Weather or Force Majeure
In the event of inclement weather, natural disasters, local strikes, or any other circumstances beyond our reasonable control (“Force Majeure”), the Company reserves the right to cancel or modify any Tour for safety or operational reasons. In such cases, you will be offered one of the following options:

Rescheduling to a future date at no additional cost, subject to availability; or

A full refund of the amounts paid if rescheduling is not feasible.

3.2 Minimum Participant Requirements
Certain Tours may require a minimum number of participants. If this requirement is not met, the Company reserves the right to cancel or reschedule the Tour. In the event of such cancellation, you will be provided with a full refund or an alternative date, as mutually agreed upon.

4. Dispute Resolution Process

4.1 Initial Contact
If you have a dispute or concern related to billing, service quality, or any other matter, you agree to first contact us directly at +39 388 855 6611 (call or WhatsApp) or info@parthenopeadventures.com. We strive to acknowledge receipt of any dispute or concern within two (2) business days.

4.2 Good Faith Negotiations
The parties shall endeavor, in good faith, to resolve any dispute through friendly and constructive negotiations. Both parties agree to provide any supporting documentation or clarifications necessary to facilitate a resolution.

4.3 Mediation or Arbitration
In the event that a dispute cannot be resolved through direct negotiations, the Company may suggest mediation through an independent third party or, if mutually agreed upon, arbitration in accordance with the rules of an accredited arbitration institution. Any costs related to mediation or arbitration shall be borne as determined by the appointed mediator or arbitrator.

5. Refund Processing

5.1 Approval and Timeline
Once a refund request has been approved pursuant to the terms of this Policy, the Company will initiate the refund within seven (7) to fourteen (14) business days.

5.2 Refund Method
Refunds will be processed using the same payment method originally used by the Customer unless an alternative refund method is agreed upon in writing by both parties. Processing times may vary depending on the financial institution or payment service provider.

5.3 Partial Refunds
Where a partial refund is issued in accordance with this Policy, the refund amount will be calculated based on the applicable percentage of the total price paid for the Tour or service in question.

6. Limitations of Liability

6.1 Extent of Liability
The Company’s liability for any breach of this Policy or the terms associated with the Tour shall be limited to the amount paid by the Customer for the Tour in question. In no event shall the Company be liable for any indirect, consequential, or incidental damages arising out of or in connection with the provision of services.

7. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of Italy. Any legal action or proceeding arising out of or relating to this Policy shall be brought exclusively in the courts of the city of Naples, unless otherwise required by applicable law.

8. Changes to This Policy

The Company reserves the right, at its sole discretion, to modify or replace any part of this Policy at any time. In the event of a material change, we will notify Customers by email or by posting a notice on our website at least seven (7) days before such changes take effect.
